Terms of Service

1. Acceptance of Terms

By downloading, installing, or using PGMS, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and UniTekra Solutions Private Limited.

2. Description of Service

PGMS is a digital platform that facilitates the management of Paying Guest (PG) accommodations. The Service enables PG owners and managers to manage rooms, tenants, rent collection, and financial records, while enabling tenants to track payments, view lease details, and communicate with their PG managers. The Service is provided "as is" and may be modified, expanded, or discontinued at any time.

3. Eligibility

You must be at least 18 years of age to use the Service. By using PGMS, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and are not barred from receiving the Service under any applicable law.

4. User Accounts

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account at mahendra.b@unitekra.tech.
• UniTekra reserves the right to terminate accounts that violate these Terms.

5. User Responsibilities

As a user of PGMS, you agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws and regulations.
• Provide accurate and truthful information about yourself, your property, or your tenancy.
• Maintain the security of your login credentials and not share them with any third party.
• Respect the privacy and rights of other users within the platform.
• Promptly report any technical issues or bugs to our support team.
• Keep your contact information up to date within the application.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable local, state, national, or international law or regulation.
• Using the Service to transmit unsolicited or fraudulent messages.
• Attempting to gain unauthorised access to any portion of the Service or any other systems/networks connected to the Service.
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity.
• Collecting or harvesting any personally identifiable information from the Service.
• Using the Service for any commercial solicitation without our prior written consent.
• Uploading or transmitting viruses or any other malicious code.
• Engaging in any automated data collection (scraping, crawling, or similar techniques).
• Using the Service to facilitate or promote illegal activity of any kind.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of UniTekra Solutions Private Limited and its licensors. Our trademarks, logos, and service marks may not be used in connection with any product or service without the prior written consent of UniTekra. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service solely for its intended purpose.

8. Payments

PGMS facilitates rent payment tracking and notifications. Any financial transactions conducted through the Service are processed by certified third-party payment gateways. UniTekra is not responsible for errors made by payment processors. In case of a payment dispute, please contact the relevant payment gateway and notify us at mahendra.b@unitekra.tech.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. UNITEKRA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UNITEKRA SOLUTIONS PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, goodwill, use, or other intangible losses
• Unauthorised access to or use of our servers and/or any personal information stored therein
• Interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or the like that may be transmitted through the Service
• Errors or omissions in any content, or any loss or damage incurred as a result of using any content available via the Service

UniTekra's total cumulative liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid to UniTekra in the twelve (12) months prior to the claim, or INR 1,000, whichever is lower.

11. Indemnification

You agree to defend, indemnify, and hold harmless UniTekra Solutions Private Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. If you wish to terminate your own account, you may contact us at mahendra.b@unitekra.tech.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, specifically the Information Technology Act, 2000 and applicable rules thereunder, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date and, where appropriate, by sending a notification through the app. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
